General Terms of Use and Booking

1. Purpose

Wikicampers is an online platform that allows owners of recreational vehicles to offer their vehicles for rent to tenants.

Wikicampers provides tools for managing listings, rental contracts, and payments, but is not a party to the rental contracts concluded between Owners and Tenants. The vehicles remain under the exclusive responsibility of the Owner and the Tenant.

2. Definitions

  • User : any person accessing Wikicampers, whether a member or not.

  • Member : User registered on Wikicampers.

  • My Account : personal space of the Member, protected by password.

  • Owner : Member renting out a vehicle.

  • Professional renter : legal entity whose activity is related to the automobile and who rents its vehicles via Wikicampers.

  • Tenant : Member reserving a vehicle. An Owner cannot be a Tenant of their own vehicle.

  • Insured : any user whose vehicle is covered by an insurance contract taken out via Wikicampers.

  • Rental contract : contract signed between the Owner and the Tenant, provided by Wikicampers.

3. Registration conditions

  • Registration on Wikicampers must be done under true identity.
  • One account per person is allowed.
  • Registration is free.
  • To register, the User must fill out the online form, provide their information, and accept these General Terms and Conditions of Use and Booking.

4. Publication of listings

  • The Owner must provide accurate information about their vehicle and accept these GTC and the Insurance Conditions.
  • Listings are subject to validation by Wikicampers, which reserves the right to refuse any listing.
  • The Owner agrees not to specify their address, email, or phone number in the description of their listing.

Wikicampers reserves the right to accept or refuse listings proposed by Owners.

5. Operation of reservations

  • The Tenant chooses a vehicle based on the criteria they want for their rental (type of vehicle, location, dates,...). They can make multiple rental requests for different vehicles. 
  • The reservation request must be made at least 12 hours before the start of the rental.
  • The Owner accepts or refuses the request via their account.
  • A rental is confirmed when the payment is validated and all necessary documents are transmitted (see article 8).

6. Payment and reservation modifications

6.1 Payment

Payment for reservations is made only via the Wikicampers platform, by one of the following means: credit card, bank transfer, Paypal, gift voucher, or connected holiday vouchers. Other payment methods are refused.

Payments made outside the Wikicampers platform are not covered by the platform, and Wikicampers cannot be held responsible for these transactions.

 

For a reservation:

  • Less than 30 days before the start of the rental : full payment required.
  • More than 30 days before the start of the rental : in case of payment by credit card, the Tenant can choose to pay for their reservation in installments without fees. A first payment of 30% is made to confirm the reservation, with the balance being charged monthly. The payment schedule is clearly indicated during the payment method selection step.

In any case, the reservation must be fully paid 30 days before departure. 

In the absence of payment of the balance by this date, the reservation will be automatically canceled by Wikicampers. In this case, 30% of the reservation amount remains due by the Tenant, the rest being refunded.

Payment for modifications or additional options must be made before the start of the rental.

6.2 Reservation modifications

After confirmation, certain modifications can be made by the Tenant, subject to the rules below.

 

Modifications possible without Owner approval:

 

  • Adding options offered by the Owner (e.g., table and chairs kit, solar shower).
  • Adding a “Comfort” or “Serenity +” insurance package, according to conditions and deadlines defined by the platform.

 

Modifications subject to Owner approval:
  • Travel abroad.
    Modification of rental dates.
  • Extension of the rental.
  • Modification of the mileage package.

If at least one modification is submitted for Owner approval, the Owner must accept or refuse all requested modifications. Example: if the Tenant requests an unlimited mileage package and a trip abroad, the Owner cannot accept one and refuse the other; they must decide on the whole, and the Tenant may submit a new request in agreement with the Owner.

Validated modifications are subject to payment, according to the conditions and options defined by Wikicampers.

In case of refusal or non-payment of the amounts due for the modification, the reservation is maintained under the initial conditions. The Tenant may still cancel it subject to paying the applicable cancellation fees according to these GTC.

7. Security deposit

7.1. If the vehicle is insured via Wikicampers: 

When the vehicle is insured through Wikicampers, the security deposit is made to Wikicampers, which guarantees the Owner up to the amount of the deposit.
The amount of the security deposit depends on the insurance plan chosen by the Tenant and must be made by credit card imprint before departure.


In case of refusal or impossibility of collecting the security deposit:

  • The reservation cannot be maintained and will be automatically canceled.
  • Cancellation fees apply according to the general rental conditions (for example, 30% of the reservation amount if applicable).
    Wikicampers reserves the right to refuse any other payment method for the security deposit and to consider the reservation as invalid until the deposit is validated.

The security deposit aims to cover, in case of accident or damage:

  • Insurance deductibles exceeding the amount of repairs.
  • Repair costs if they are less than the deductible.
  • Damage to the interior of the vehicle and breakage of equipment not covered by insurance.
  • Administrative fees of 50 € including tax per claim.

At the end of the rental, if no claim or damage is reported, the bank imprint is canceled within 8 days. The Tenant is informed by email.

Wikicampers can cash the security deposit as soon as a claim file is opened and, as a precaution, proceed to compensate the Owner when justified.

In case of recourse or dispute, if the Tenant is found not responsible for the claim, the Owner agrees to immediately refund the amount received, so that Wikicampers can return the deposit to the Tenant.

Wikicampers acts only as a precaution and cannot be held responsible for any delays or difficulties in the return of funds. In case of recourse, Wikicampers is subrogated in the rights of the Owner to recover the amount from the Tenant if the latter is found responsible.

 

7.2. If the vehicle is insured by a professional or private owner outside of Wikicampers insurance:

  • The Tenant makes the security deposit directly to the Owner, according to the terms set by the latter.
Vehicle insured by a private Owner
  • If the vehicle is not covered by Wikicampers insurance, the security deposit is made to Wikicampers as a trusted third party.
  • The amount is 2,500 €, to be paid by credit card imprint before departure. In case of non-payment, the reservation will be canceled.
  • The Owner must provide the certificate and insurance contract to the Tenant.
  • At the end of the rental, if no claim or damage is reported, the bank imprint is canceled within 8 days.
  • In case of claim or damage, the security deposit is paid to the Owner to cover the costs according to the rental contract and these GTC.

8. Documents to provide

8.1 As a private owner

When publishing their listing, the Owner must submit a scan of the final registration certificate as well as their identity document and bank identity statement, to receive their payment by bank transfer.
Before the start of each rental, the Owner must imperatively provide a copy of the registration certificate of their vehicle to their tenant.

 

8.2 As a professional owner

When publishing their listing, the Owner must submit a scan of the identity document of the manager, the final registration certificate of the vehicle(s) in the name of their company, as well as the KBIS of said company, and their bank identity statement, to receive their payment by bank transfer.

If the professional owner has opted to use their own insurance, they must upload their insurance certificate, which will be made accessible to the tenant. Before the start of each rental, the Owner must imperatively provide a copy of the registration certificate of their vehicle to their tenant.

8.3 As a tenant

The Tenant must provide the following documents as soon as their reservation is confirmed:

  • Scan of the driving license of each driver (limited to 2 drivers);
  • Security deposit (see Article 9)

The Owner and the Tenant must provide these documents via “My Account” for online document upload, section “My listing” (for the owner), section “My drivers” (for the tenant)

9. Cancellation

9.1 Cancellation by the Tenant

  • Date modification: if the tenant modifies the date, any subsequent cancellation does not entitle to any refund.
  • No-show of the tenant: no refund.
  • Travel options, payment fees, and service fees: non-refundable.

  • The reservation modification is subject to the Owner's acceptance.
  • No-show: no refund.
  • Travel options, payment fees, and service fees: non-refundable, except for cancellations ≥ 30 days (fully refunded).

  • Payment to the Owner: bank transfer within 8 days following the cancellation.

9.2 Cancellation by the Owner

  • The Owner must cancel from their account and provide proof within 15 days.
  • Cancellation fee: 150 € including tax, to be paid within 15 days, deductible from the next rental if not paid.
  • The Tenant receives:
    • Gift voucher for the total amount paid (excluding travel options and payment fees), valid for 1 year, usable multiple times. The Tenant also has the option, at the time of booking, to subscribe to optional cancellation insurance covering cancellation fees according to the conditions provided in the insurance contract.
    • If cancellation occurs between 7 days and the day of departure: discount code of 10% on a future reservation (> initial amount, departure max 5 days after the initial date, excluding travel options and insurance).
  • If no substitute vehicle is available: refund of the gift voucher by bank transfer within 8 days.



9.3 Cancellation due to vehicle breakdown

  • If the rental is interrupted due to mechanical breakdown: compensation handled by the Insurance Department.
  • Travel options, insurance, payment fees, commission, and service fees: non-refundable.
  • Tenant and Owner must provide proof by email to [email protected] as soon as possible.

 

9.4 Cancellation in case of travel restrictions (force majeure)

  • In case of confinement, border closures, or fuel shortages: cancellation possible without notice.
  • Owner: no compensation.
  • Tenant: gift voucher for the total amount paid (excluding travel options and payment fees), valid for 18 months.

 

10. Obligations

The Owner (private or professional) agrees to: 

  • Offer a vehicle in a compliant and safe condition, with maintenance recommended by the manufacturer, up-to-date technical checks, and functional safety equipment (tires, brakes, levels, lights, steering, battery, vest, and triangle).

  • Be solely responsible for the description of the vehicle provided on the site.

  • Provide all mandatory documents and leave the insurance certificate in the vehicle.

  • Inform the tenant of any tracker installed before the start of the rental.

  • For professional owners or those who have made artisanal modifications: ensure that the vehicle complies with all applicable standards, possibly through a DREAL check (Regional Directorate for the Environment, Planning and Housing).

  • For professional owners: use the automatic acceptance of rental requests via the platform. Any request received must be confirmed via Wikicampers. Accounts used solely for contact or data collection will be blocked.

 Insurance

  • If the vehicle is covered by Wikicampers insurance: the owner is insured via our platform.

  • If the vehicle is not covered by our insurance: the owner must take out a contract allowing rental and provide the insurance contract in their listing.

The Tenant agrees to: 

  • Drive carefully and in accordance with the highway code.
  • Use the vehicle only for private purposes.
  • Maintain the vehicle, its equipment, and accessories in good condition.
  • Not use the vehicle for:

-Paid transport of passengers;

-Towing or propelling another vehicle, trailer, or object;

-Competitions; 

-Illegal activities;

-Learning to drive.

11. Rental contract

Contract regime


The rental contract is governed by the notice accessible on the page rental contract notice. Wikicampers provides a pre-filled rental contract for each reservation, downloadable from “My Account” as soon as all necessary elements have been transmitted by the parties (see Article 10).

Mobile application and signature


A free mobile application is available to users. The rental contract is available there from the day of departure, facilitating the inventory with photo taking and the digital signature of the contract. The Tenant and the Owner then receive a copy of the contract signed by email.

Tracker


The Tenant is informed that the vehicle may be equipped with a tracker, installed by the Owner. The Owner assumes full legal and regulatory responsibility related to the processing of personal data.

Duration and conclusion


The rental contract is concluded directly between the Owner and the Tenant at the time of taking over the vehicle and the inventory. For short-term rentals, the contract cannot exceed 3 consecutive months. The identity of the Tenant, the vehicle, and the rental dates must correspond to the information recorded on the site

Signature and retention


The rental contract must be signed by the Owner and the Tenant at the beginning and at the end of the rental, in duplicate. Each party keeps their copy.

Abandonment of the vehicle or refusal to sign the inventory

  • If the Tenant abandons the vehicle or refuses to sign the inventory at the end of the rental, the Owner may ascertain the condition of the vehicle by any credible means, including dated and time-stamped photographs taken via the mobile application or any other reliable support.
  • In this case, the rental contract remains fully valid, and Wikicampers may enforce the provisions related to the security deposit, repairs, and any fees, even if the inventory has not been signed by one or more parties.
  • The parties acknowledge that the signature of the contract or the inventory is not a suspensive condition for the application of contractual obligations and that documentary evidence (photos, emails, messages via the platform) is valid.



12. Insurance

12.1 Rental from a professional renter

When the rental is made by a professional renter, the insurance terms are those specified in the listing and at the time of payment. The professional Owner can use their own insurance or subscribe via Wikicampers according to their choices.

12.2 Rental from a private owner

When the rental is insured by the partner insurer of Wikicampers, the vehicle is covered by the following guarantees:

a. Mandatory civil liability (or third-party insurance)


The civil liability insurance is included in the rental contract according to the conditions on the Insurance rental page. Wikicampers is responsible for subscribing and paying the insurance premiums.

 

b. Damage to the vehicle (theft, fire, damage)
  • Damage caused to the vehicle is covered by Wikicampers;
  • The Tenant's liability is limited to the deductible indicated in the contract, according to the chosen plan (Basic, Comfort, or Serenity+).
  • Subscribing to a Comfort or Serenity+ plan reduces the amount of the deductible.
  • Damage exceeding the deductible is covered by Wikicampers 

 

c. Claims management
  • The Owner assigns to Wikicampers their claim in the management of claims and agrees that Wikicampers is paid on their behalf via their managing broker.
  • The Owner must provide all necessary documents to open the file (signed rental contract, photos of the damage) within 48 hours following the end of the rental.
  • Estimates and invoices must be submitted for the file processing. Without these documents, Wikicampers may refuse or close the file one year after the claim.

12.3 Guarantees and deductibles

  • The deductible is the responsibility of the Tenant when they are responsible or when no identified third party is involved.
  • The deductible applies for each event; multiple deductibles may apply for distinct claims.
  • In case of an accident with an identified third party (insured outside France), Wikicampers may collect the security deposit and will reimburse the Tenant according to the degree of responsibility after recourse.
  • The theft and fire guarantees also apply to transported items, with exclusions specified on the Insurance rental page.
  • The theft guarantee includes the non-return of the vehicle by the Tenant (breach of trust or fraud).

12.4 Exclusions

The Tenant is not insured in the following cases:

  • Use of the vehicle outside the private framework or transport of passengers for a fee;
  • Theft of the vehicle if the Tenant does not return the original keys;
  • Driving under alcohol, drugs, or medications causing drowsiness;
  • Damage occurring after the end of the rental;
  • False information about identity or license;
  • Deliberate damage;
  • Overloading or exceeding the number of authorized passengers.

12.5 Expertise

  • If the repair estimate exceeds 1,500 €, an independent expert is mandated.
  • The damages are assessed according to the manufacturer's methodology (parts and labor).
  • Depreciation is not covered by the insurer and remains the responsibility of the Owner.
  • In case of disagreement, each party may request a counter-expertise at their own expense.
  • Failure to comply with deadlines or formalities results in loss of the right to compensation.

 

12.6 Files outside “coverage”, called “amicable”

In the context of insured vehicles, certain damages may be subject to an amicable settlement between the Owner and the Tenant.

  • Damages not covered by insurance are covered by the security deposit paid by the Tenant.
  • The settlement is made on an invoice issued by the Owner, in accordance with the estimate validated by the Insurance Service, if applicable.
  • A flat-rate compensation may be applied by mutual agreement between the Owner and the Tenant, or according to the conditions specified in the rental contract notice.

Wikicampers acts only as a connection platform and cannot be held responsible for agreements or settlements made between the parties in the context of these files.

12.7 Vehicle assistance

  • Vehicle assisted 24/7, assistance available with a simple call to the assistance provider with whom Wikicampers has contracted.

  • Repairs related to mechanical breakdowns are the responsibility of the Owner.

  • The Owner must compensate the Tenant for loss of enjoyment according to the conditions of the notice.

12.8 Loss of Earnings Insurance Option

 

The subscription applies to one vehicle and is associated with a single registration.

The exhaustive detail of the guarantees applicable to loss of earnings insurance is defined by the insurance contract available on the Insurance page Loss of Earnings.

The Insured may exercise their right of withdrawal with Wikicampers within 14 days:

  • by mail: 29 allée Grace Hopper - 64210 BIDART
  • by email: [email protected]
  • according to the following model:

« I, the undersigned, NAME, FIRST NAME AND ADDRESS wish to withdraw from my membership in the Loss of Enjoyment Insurance Contract, DATE AND SIGNATURE ».


From the date of sending by the Insured of the notification letter of their withdrawal, the Insurance ends.
The amount of the premium possibly paid will be refunded within thirty (30) days from the date of exercise of the right of withdrawal by the Insured

12.9 Responsibility of Wikicampers

Wikicampers facilitates and secures the rental of recreational vehicles between individuals.

 

Wikicampers is not a rental company but an internet platform for rental listings.

 

Wikicampers is in no way a party to the contracts concluded between Owners and Tenants. The rights and obligations related to the rental are exercised exclusively between the Owner and the Tenant. Wikicampers acts only as an intermediary for connecting and declines any responsibility related to the execution, content, quality, or conditions of the contracts concluded between users.

 

Wikicampers cannot confirm the identity of each Member nor the identification of the vehicles. It is the responsibility of the Tenant and the Owner (or their representative) to verify their respective identities.

 

The information provided by the intermediary of the site may contain technical or factual inaccuracies or typographical errors. Wikicampers declines any responsibility for such inaccuracies and errors and reserves the right to make modifications and corrections at any time, without notice.

 

It is the responsibility of the Owners to declare and pay all taxes and duties related to the rental of vehicles.

 

For professional renters, the income must be considered as professional income.

13. Termination and exclusion

Wikicampers has the right to exclude a user at any time and without notice.

14. Modifications of the general sales conditions

The use of the Wikicampers site and its services is subject to acceptance of these terms. Wikicampers reserves the right to modify them at any time. The modification will take effect immediately upon the posting of the new conditions, which every user acknowledges having previously consulted.

In case of modification, the new conditions will only apply to reservations made after the modification.

15. Intellectual property rights

All elements present on the site Wikicampers.fr (software, content, information, documents, and images) are the property of the company Hors Limites 64. Any reproduction, even partial, is subject to the prior written authorization of the company Hors Limites 64. The company disclaims any responsibility in case of violation of rights held by third parties and committed due to any activity or non-compliant use of the site by a User.

16. Personal data

In the context of using the site and the services offered by Wikicampers, personal data may be collected and processed by the company, including the following data: name, first name, postal address, email address, phone number, information related to the user account, reservations, published listings, as well as transactions made on the platform.

 

This data is collected and processed for the purposes of:

  • the creation and management of user accounts,
  • the connection of Owners, Tenants, Buyers, and Sellers,
  • the management of reservations, rentals, and sales,
  • the execution and monitoring of services offered by Wikicampers,
  • as well as compliance with legal and regulatory obligations.

 

These processes are carried out in compliance with the provisions of Law No. 78-17 of January 6, 1978, as amended, and the applicable regulations regarding the protection of personal data.

 

By using the site and services, users acknowledge and agree that their personal data may be collected and processed by Wikicampers under the specified conditions.

 

Data is retained for the strictly necessary duration for the purposes pursued and, in any case, for a maximum period of five (5) years from the last activity of the user. Banking data is never retained by Wikicampers.

 

Furthermore, the company may, unless indicated otherwise by the client sent by email to [email protected], use the personal data concerning them (excluding banking data) to send them directly or through partners commercial offers that may interest them.

 

Under the Data Protection Act, the client has the right to oppose the receipt by email of unsolicited commercial prospecting documents.

 

The client also has the right to access, modify, rectify, or delete data concerning them (Article 34 of the “Data Protection Act”), and may also oppose the transmission of their personal data to third parties by sending an email to the Wikicampers Customer Service.

17. Applicable law and competent jurisdictions 

The General Terms and Conditions of Reservation and Use are subject to the provisions of French law.

 

In the event of a dispute regarding the validity, execution, or interpretation of this Contract and brought before the civil courts, it will be subject to the exclusive jurisdiction of the French courts to which express jurisdiction is granted, even in the case of referral or multiple defendants.

 

In case of dispute between the parties, Wikicampers will take a position based on the completed and signed rental contract, these conditions, and the rental contract notice without obligation of result. If the elements are not sufficiently probative to establish responsibilities, Wikicampers will propose a cost-sharing divided equally between the Owner and the Tenant. The parties to the contract are free to refer to the competent jurisdictions and/or seek their advice to reach an agreement other than that proposed by Wikicampers.

 

In the event of a dispute between the platform and the Owner or between the Owner and the Tenant following a rental, Wikicampers may, at its discretion and as a precaution, temporarily suspend the payment of all or part of the amounts due to the Owner for ongoing or future rentals, pending resolution of the dispute.

 

In the event that the Owner is found liable for an amount owed to the Tenant and refuses to pay it, Wikicampers may, to the extent possible, proceed to retain and, if applicable, return all or part of the amounts concerned to the Tenant, without this constituting an obligation for Wikicampers or a guarantee of handling the dispute or its outcome.

 

Any request for a complaint or information regarding insurance mediation can be sent in writing to the following address: Wikicampers Claims Service, 29 allée Grace Hopper 64210 Bidart. You will receive an acknowledgment of receipt within a maximum of 10 days and a response within 2 months.

 

In accordance with Article L. 612-1 of the Consumer Code, the consumer, subject to Article L.612.2 of the Consumer Code, has the option to submit a request for amicable resolution through mediation, within one year from their written complaint to the professional.

 

HORS LIMITES 64 has designated, by registered membership number 17332/VM/2511 the SAS Mediation Solution as the consumer mediation entity.

 

To refer to the mediator, the consumer must submit their request:

Regardless of the means of referral used, the request must necessarily contain:

 

  • The postal, telephone, and electronic contact details of the requester,
  • The name, address, and registration number with Sas Mediation Solution of the concerned professional,
  • A brief statement of the facts,
  • Copy of the prior complaint,
  • All documents allowing the processing of the request (order form, invoice, proof of payment, etc.)

1. Definitions

For the purposes of these General Terms and Conditions of Sale (GTCS), the terms below have the following meanings:

  • Vehicle: any recreational vehicle or caravan allowing one or more people to travel, sleep, and cook inside.
  • Fitting: removable equipment designed to equip vehicles so that they can be used as recreational vehicles.
  • User: any natural or legal person accessing the site, whether or not they are a Member.
    Member: User identified on the site in order to use its services.
  • Seller: Member selling a Vehicle or a Fitting on the site.
  • Buyer: Member wishing to purchase a Vehicle or a Fitting on the site.
    Goods: any Vehicle or Fitting offered for sale on Wikicampers.
  • Order form: document sent to the Buyer detailing the characteristics of the Goods.
  • Delivery certificate: document signed by the Buyer, certifying that the Goods have been received and are compliant.
  • Included services: services provided as part of the sale of vehicles between individuals via Wikicampers.
  • Service options: additional services offered when purchasing the Goods.
  • Trusted third party: Wikicampers acting to protect the transaction between users.
  • Certified history: warranty booklet issued by Autoviza, listing the maintenance and technical checks of the vehicle.
  • Mechanical breakdown warranty: service included for certain vehicles under 10 years old and 150,000 km, provided by a third-party provider after inspection of the vehicle.

It is expressly reminded that the warranty is offered by a third party and that the inspection report is carried out by a third-party provider. The responsibility of Wikicampers cannot be engaged in any way for the content of the report or regarding the conditions of the warranty.

Wikicampers reserves the right to initiate an inspection report on certain listings that meet the conditions defined by the platform, particularly when the proposed price for the vehicle corresponds to the estimate communicated by Wikicampers.

The costs related to this inspection report will be incurred in accordance with the conditions associated with the listing.

The inspection report is provided for informational and indicative purposes and does not engage the responsibility of Wikicampers regarding the content of the report or the final value of the vehicle.

2. Purpose

Wikicampers facilitates the purchase and sale of recreational vehicles and fittings by providing a platform for connection. Wikicampers acts as a trusted third party but never becomes the owner of the Goods.

These GTCS define the conditions for publishing listings and selling via the site.

3. Registration

To sell or purchase Goods, Users must become Members of Wikicampers, providing accurate and complete information. 

Registration is free and limited to one account per person.

Members must accept these General Terms and Conditions of Sale and will be notified by email once acceptance is made. This email will confirm the action they have taken and specify the date and time of acceptance of the said General Terms and Conditions of Sale, (in their version on the day of validation) with a link that can be consulted at any time.

 

4. Publication of a listing

The Seller agrees to:

  • Verify that the Goods meet the required conditions to publish their listing (see Article 8);
  • Fill out an electronic form in which they provide:
    • information about their identity (for natural persons: name, first name, address, phone number. For legal persons: company name, SIRET number, registered office address, name of the company representative in the context of the sale, phone number);
    • information about the subject of the listing (location, equipment, photos, price, registration plate, and vehicle registration document for Vehicles, etc.).
  • Provide the buyer with a current technical inspection of less than 6 months at the latest on the day of delivery. for Vehicle sales;
  • Provide their identity document, proof of residence, and bank identity statement for natural persons or their updated K-bis and bank identity statement for legal persons;
  • Describe their Goods according to the criteria requested on the Wikicampers site;
  • Submit their Vehicle for inspection by a Wikicampers partner for any listing finalized at the market price. The Seller acknowledges that the report established following the inspection may be consulted by Buyers 

The Seller also acknowledges that the photographs accompanying the report are the exclusive property of Wikicampers;  It is expressly reminded to Sellers and Buyers that the inspection is carried out by a third-party organization. The role of Wikicampers is limited to putting the Seller in contact with this organization and publishing the results of the inspection on the Site. The responsibility of Wikicampers cannot be engaged in any way for the content of the report or the modalities of carrying out the inspection;

  • Accept these GTCS.

Wikicampers reserves the right to refuse or remove any listing not in compliance with these GTCS and to disseminate the listings on its partner platforms.

 

5. Exclusivity and Seller commitments

In the context of publishing a Sales Listing of their Goods on the Wikicampers site, the Seller agrees to respect an exclusivity period of 60 days during which they are prohibited from selling, exchanging, transferring, or finalizing any sale, transfer, or exchange of their Goods by other means or on another platform.

 

If the Seller does not respect the exclusivity period, they agree to pay a commission of 5% of the sale price of the Goods displayed on the site at the time of the creation of the listing, to Wikicampers.

 

This period takes effect from the publication of the listing on the site. For any other reason, in the event that the Seller no longer wishes to sell their vehicle on the platform during the exclusivity period, they agree to reimburse the costs related to the publication of the listing by Wikicampers.

 

It is also specified that any sale occurring beyond the exclusivity period but within 18 months following the posting of the listing and which would have taken place between the Seller and a buyer with whom the Seller has been in contact through Wikicampers, and during the exclusivity period must be finalized through Wikicampers. Otherwise, the Seller agrees to pay a commission of 5% of the sale price of the Goods to Wikicampers.

 

Following an inspection, planned or carried out, the Seller who renounces their sale project on the Wikicampers platform between the inspection request and the publication of the listing agrees to pay the costs related to the inspection.

 

When they have benefited from the free inspection of their vehicle, the seller agrees not to increase the price beyond the amount estimated by Wikicampers.



This estimate is established for purely indicative purposes, based in particular on the information communicated by the Seller, the market data available on the day of the estimate, and the internal tools of Wikicampers.  It does not constitute an expertise, a guarantee of value, or a commitment of sale price from Wikicampers.

6. Operation of the platform and reservation

Any User wishing to sell Goods on the Wikicampers site must first become a Member of Wikicampers and proceed to publish their listing as described in Article 3 of these.

 

Listings published by Sellers are visible to all Users of the site. However, Users must become Members to be able to contact Sellers.

 

Any Member wishing to acquire Goods sold on the Wikicampers site must leave a message to the Seller via the Wikicampers platform. The Buyer has the option to leave their phone contact details with the Seller to facilitate exchanges. When a Buyer contacts a Seller about their Goods, the Seller is informed by email and SMS (in the case where they have provided a mobile phone number).

 

The Buyer has the possibility to engage in discussions with the Seller, which may lead to the sale of the Goods to the benefit of the Buyer. Furthermore, the Buyer has the option to directly reserve the Seller's Goods online, without requiring prior acceptance of the contact by the Seller.

 

In the event that the Seller does not wish to proceed with the sale of their Goods, they must notify the Wikicampers customer service within 48 hours from the reservation made by the Buyer. An automatic email is sent to the Seller at the time of the reservation allowing them to notify Wikicampers of their refusal with a simple click. This notification will result in the cancellation of the reservation.

 

Following the reservation, the Buyer will have access to the inspection report established by the designated external provider, allowing them to learn about the condition of the Vehicle.

 

To reserve the Goods, the Buyer must:  

  • send Wikicampers their identity document as well as proof of residence if they are a natural person or send their K-bis if they are a legal person;
  • select their choice of financing as well as the Service Options they wish to benefit from;
  • pay the reservation fees. 

At the end of the reservation, an Order form is sent to the Buyer.

 

Once the reservation of the Goods is made, the Buyer agrees to pay the purchase price to Wikicampers within 15 days following the reservation in the case of personal financing.

 

In the case of financing via Cofidis, the Buyer agrees to sign a fund release certificate with Cofidis. The funds must then be paid to Wikicampers by Cofidis within 15 days following the reservation.

 

Once the funds are received by Wikicampers, Wikicampers will immediately inform the Seller and the Buyer so that they can proceed with the delivery of the Goods, which must take place within 10 days following the receipt by Wikicampers of the sale price. In the case of financing by Cofidis, delivery can only take place after the acceptance of the financing file by Cofidis.

 

A Delivery Certificate is signed by the Buyer on the day of delivery in the case where the Goods correspond to the characteristics as described in the documents accessible from the Wikicampers site.

 

The Seller agrees to provide the Buyer with a technical inspection of less than 6 months at the latest on the day of delivery.

 

The delivery certificate as well as the transfer certificate are then sent to Wikicampers, which upon receipt has a period of 72 hours to release the funds to the Seller.

 

All sales made through Wikicampers are subject, without reservation, to these General Terms and Conditions of Sale.

6 bis – Offers for professionals

Wikicampers offers specific offers for professionals in vehicle sales wishing to publish their listings on the platform.

 

The conditions applicable to these offers (notably the included services, financial conditions, and billing modalities) are subject to a separate contract concluded directly between Wikicampers and the concerned professional.

 

In any case, Wikicampers acts solely as a platform for connection and is not a party to the transactions concluded between the professional and the buyers.

 

7. Payment methods

Wikicampers acts as a Trusted third party in the sale by collecting the sale price and only transferring it to the seller upon signing a Delivery Certificate.

 

Once the Seller and the Buyer agree on the principle of the sale, the Buyer proceeds to reserve the Goods by paying the reservation fees. These reservation fees are intended for Wikicampers and are non-refundable.

 

Once the reservation is made, the Buyer must proceed to pay for the Goods.

 

This payment is made to Wikicampers and depending on the chosen financing option:

a. Purchase with personal financing from the Buyer

The Buyer agrees to pay the funds directly to Wikicampers within 15 days following the reservation of the Goods. The funds will then be blocked by Wikicampers until the receipt of the Delivery Certificate signed by the Seller and the Buyer. The funds will be released to the Seller within 72 hours following the receipt of the original signed Delivery Certificate.

b. Financing the purchase via Cofidis

At the time of payment, Wikicampers offers the natural person Buyer to finance their purchase via its partner Cofidis (COFIDIS. SA with a Management Board and Supervisory Board with a capital of 67,500,000 euros. Registered office: Parc de la Haute Borne - 61 avenue Halley - 59866 VILLENEUVE d’Ascq - SIREN 325 307 106 RCS LILLE METROPOLE. Insurance intermediary registered with ORIAS under number 07023493 (www.orias.fr)).

 

If the Buyer chooses to go through financing via Cofidis, they will then be contacted by a Wikicampers collaborator to create a financing file.

 

The file will then be sent to them by mail for signature, and they will have to send it back to Cofidis by post.

 

The Buyer agrees to respect the deadlines set by Cofidis for completing all procedures so that the funds are paid to Wikicampers by Cofidis no later than 15 days following the reservation of the Goods.

 

Any remaining amount must be paid by the buyer directly to Wikicampers no later than 15 days following the reservation of the Goods. In the event that their credit application is rejected by Cofidis or if the Buyer withdraws from their credit application, the deposit will be refunded to them by Wikicampers.

 

8. Goods offered for sale

The Goods offered for sale on the Wikicampers platform belong to natural or legal persons. These are Vehicles and/or Fittings.

 

The Seller guarantees that they have all the rights allowing them to sell the Goods subject to the listing.

 

The Seller agrees to offer for sale a compliant Goods (valid technical inspection for Vehicles) and in accordance with safety standards.

 

9. Commitment of Wikicampers

Wikicampers commits to doing everything possible to maintain the site in an operational state. However, Wikicampers reserves the right to temporarily interrupt access to its services for maintenance and/or improvement reasons.

 

Wikicampers cannot be held responsible for the quality of the User's Internet network.

 

The User agrees to personally ensure the security of their computer equipment and data, and the responsibility of Wikicampers cannot be sought for damages suffered by the User due to their connection to the Wikicampers site.

 

Wikicampers commits to facilitating the administrative procedures of its Users by providing advice in publishing listings, providing a number of included services.

 

Wikicampers makes every effort to guarantee its users maximum security:

  • By acting as a Trusted third party in the transaction;
  • By providing assistance to Sellers and Buyers in amicable dispute resolution;
  • By providing a Certified history of the vehicle provided by the Autoviza provider;
  • By allowing Sellers to benefit from an inspection by a third-party organization of their Vehicle if it is displayed at the market price, in order to benefit from the Mechanical Breakdown Warranty offered by a third-party provider.

 

Wikicampers is attentive to its users (suggestions, advice, help with using the platform, comments). Several means are available to contact customer service

10. Commitments of the buyer

Once the reservation of the Goods is made, the Buyer agrees to proceed with the payment for the Goods.

 

The Buyer agrees to comply with the instructions of Wikicampers throughout the sale.

 

The validation of the delivery of the Goods by the Buyer, materialized by the signature of the Delivery Certificate on electronic support or by any equivalent confirmation recorded on the Wikicampers platform, constitutes recognition of the compliance of the Goods and results in the irrevocable release of funds to the Seller, unless a dispute is opened under the conditions provided in these.

10.1 Cancellation of a sale by the Buyer

a. In the case of a Vehicle purchase, if the Buyer opts for financing via Cofidis, they benefit from a right of withdrawal under their loan contract. The exercise of the right of withdrawal will have the effect of canceling the sale.

b. In the event that, on the day of delivery of the Goods, the Buyer refuses to sign the Delivery Certificate on the grounds that the delivered Goods do not comply with the information provided in the documents relating to the Goods and present on the Wikicampers site.

 

Wikicampers invites the Buyer to provide proof of the elements of non-compliance observed. The Buyer will then have 7 days to respond to Wikicampers, with photographs to support. From the receipt of these elements, Wikicampers must, in its capacity as Trusted third party, refund the Buyer within 10 working days. Wikicampers will provide assistance to the Seller and the Buyer in the attempt to reach an amicable resolution in the event that a dispute arises from this cancellation by the Buyer.

10.2 Cancellation by the Seller of a validated sale

In the event that the Seller cancels a sale after their Goods have been reserved by the Buyer, in addition to the disputes that may be raised against them by the Buyer, the Seller must pay Wikicampers the cancellation fees corresponding to 5% of the price of their Goods as displayed in their listing. If the Seller does not respond within 48 hours following the confirmed reservation of their vehicle, Wikicampers considers that the absence of response equates to a cancellation of the sale by the Seller, and the fees mentioned in this article will be due.



When the cancellation of the sale occurs due to the Seller and results from an amicable agreement between the Seller and the Buyer, the Seller expressly authorizes Wikicampers to refund the Buyer the entirety of the file fees, namely a flat amount of 189 euros including tax, by offsetting against the sums owed to them or by any other means.

11. Services included for the Buyer:  

  • Certified history: For every sale of a Vehicle on its site, Wikicampers provides the Seller with a warranty booklet issued by the external provider Autoviza. This warranty booklet lists the maintenance performed on the Vehicle, the number of owners, the number of transfer certificates, and the number of technical checks performed. Wikicampers is in no way responsible for the information contained within this Certified history, and its liability cannot be engaged in this regard.

 

  • Mechanical Breakdown Warranty for eligible vehicles:

The Mechanical Breakdown Warranty covers breakdowns occurring within 3 months following the sale of the eligible Vehicle.

The Mechanical Breakdown Warranty is in no way a manufacturer's warranty or a legal compliance warranty.

The Mechanical Breakdown Warranty corresponds solely to a commercial warranty aimed at covering unforeseen breakdowns that may occur on the vehicle under the conditions set out on the page Warranties.

If a breakdown occurs during the warranty period, the Buyer must contact Wikicampers' insurance partner at 09 70 77 28 51 within 5 days following the breakdown to report the claim. They must then provide all necessary documents for the proper processing of their file.

Wikicampers does not guarantee the condition of the vehicle and cannot be held responsible for any breakdowns that occur on the vehicle. Reported breakdowns will be processed by the Mechanical Breakdown Warranty without Wikicampers' liability being engaged in any way.

  • Additional options:  

Additional service options may be subscribed to at the time of payment for the Goods by the Buyer.

Warranty Extension: The Warranty Extension allows extending the duration of the Mechanical Breakdown Warranty by 3, 9, or 21 months. It also allows for the removal of the deductible of 300 euros.

When subscribing to the extension, the Buyer agrees to return the membership documents sent by Wikicampers filled out and signed in accordance with the insurer's request.

Without returning these documents before the end of the 3 months of offered warranty, the extension cannot be declared to the insurer.

Cofidis: Under the partnership between Wikicampers and Cofidis, the Buyer will be offered to finance their purchase by credit. The characteristics of this credit are available on the dedicated page Borrow. In the case of financing via Cofidis, the Buyer will also be offered to subscribe to various guarantees (warranty extension, financial loss, and revision pack). The details of these different guarantees are available on the page Warranties.

 

Vehicle delivery:  

At the time of payment, the Buyer will have the option to subscribe to the delivery option of the acquired Goods.

 

The Goods will then be delivered to them by the partner carrier. The carrier's rate is set by them based on a quote that must be accepted by the Buyer.

 

The carrier will retrieve the Goods as well as the Delivery Certificate signed by the Buyer.

 

In the event of refusal of delivery by the Buyer on the grounds that the Goods would not comply with their description as presented in the contractual documents available on the Wikicampers site, this refusal is noted on the Delivery Certificate by the carrier. The Goods are then returned to the Seller at their expense. The Buyer agrees to promptly send the Delivery Certificate to Wikicampers.

 

On the other hand, if the Buyer refuses the delivery of Goods that comply with their description as presented in the contractual documents available on the Wikicampers site, the return of the Goods to the Seller is carried out at the exclusive expense of the Buyer. It is also the Buyer's responsibility to ensure that the Goods are effectively returned to the Seller.

12. Limitation of liability

Wikicampers is a platform allowing the connection of Sellers and Buyers and Sellers with third-party organizations offering them certain services.

 

It is not a company selling Vehicles and/or Fittings and only intervenes as a Trusted third party in the transactions carried out.

 

Consequently, Wikicampers is not a party to the sales agreements concluded between the Seller and the Buyer and therefore cannot be held responsible, in particular, for quality, safety, or legality issues of the Vehicles and Fittings offered or for the authenticity or accuracy of the listings.

 

If Wikicampers verifies them, it does not guarantee the identity of the Members nor that of the Goods offered for sale on its site. It is up to the Buyer and the Seller to verify their respective identities.

 

The information provided by the intermediary of the site may contain technical or factual inaccuracies or typographical errors. Wikicampers declines all responsibility for such inaccuracies and errors and reserves the right to make modifications and corrections at any time, without notice.

 

Wikicampers commits to implementing all necessary means to ensure the best possible access to its website. However, Wikicampers declines all responsibility in case of malfunctions, breakdowns, or interruptions of the site.

 

Wikicampers also declines all responsibility in case of non-performance or poor performance of the transactions concluded between the Seller and the Buyer. Wikicampers does not guarantee in any way the quality and condition of the Goods sold on its site by the Sellers.

 

It is expressly reminded that the certified history provided at the time of the sale of Vehicles as well as the inspection report possibly communicated in the context of the sale are established by third-party organizations. Their content is communicated for purely informational purposes and is not guaranteed by Wikicampers, which does not intervene in their preparation or validation. Consequently, the responsibility of Wikicampers cannot be engaged in any way for the content, conclusions, or any omissions, errors, or inaccuracies contained in these documents.

 

The Mechanical Breakdown Warranty is also provided by a third-party provider and is in no way insured by Wikicampers, which cannot be held responsible for damages and/or breakdowns suffered by the Vehicles sold on its site.

 

The responsibility of Wikicampers can only be engaged in case of failure to meet its own contractual obligations as defined by these General Terms and Conditions of Sale.

 

Wikicampers commits to assisting Buyers and Sellers in the event of disputes arising from the sale of Goods on its site. However, Wikicampers reminds that this assistance constitutes only an obligation of means and is strictly limited to the amicable phase of resolving any disputes. In any case, no assistance will be provided by Wikicampers beyond a period of 6 months following the sale of the Goods or the cancellation of the sale of the Goods.

 

Members are solely responsible for damages caused to third parties by their transactions.

 

The Seller agrees to indemnify Wikicampers against any claims or actions related to their listing or the Goods offered for sale and/or sold that may be brought against it and to bear all legal costs that may have been incurred by Wikicampers.

13. Taxes and duties

It is the Seller's responsibility to declare and pay all taxes, duties, and levies related to the sale of their Goods.

 

For professional sellers, the income must be considered as professional income.

14. Exclusion

Wikicampers has the right to exclude any user at any time, without notice and without compensation.

15. Modifications to the general terms and conditions of sale

The use of the Wikicampers site and its services is subject to acceptance of these General Terms and Conditions of Sale. Wikicampers reserves the right to modify them at any time. The modification will take effect immediately upon the posting of the new conditions that any User acknowledges having previously consulted.

 

In case of modification, the new conditions will only apply to reservations made after the modification.

 

16. Intellectual property rights

All elements present on the site Wikicampers.fr (software, content, information, documents, and images) are the property of the company Hors Limites 64. Any reproduction, even partial, is subject to the prior written authorization of the company Hors Limites 64. The company disclaims any responsibility in the event of violation of rights held by third parties and perpetrated due to any activity or non-compliant use of the site by a User.

 

17. Personal data

In the context of using the site and the services offered by Wikicampers, personal data may be collected and processed by the company, including the following data: name, first name, postal address, email address, phone number, information related to the user account, reservations, published listings, as well as transactions carried out on the platform.

 

This data is collected and processed for the purposes of:

  • the creation and management of user accounts,
  • the connection of Owners, Renters, Buyers, and Sellers,
  • the management of reservations, rentals, and sales,
  • the execution and monitoring of services offered by Wikicampers,
  • as well as compliance with legal and regulatory obligations.

 

These processes are carried out in compliance with the provisions of law n°78-17 of January 6, 1978, as amended, and the applicable regulations regarding the protection of personal data.

 

By using the site and services, users acknowledge and accept that their personal data may be collected and processed by Wikicampers under the conditions specified.

 

Data is retained for the strictly necessary duration for the purposes pursued and, in any case, for a maximum period of five (5) years from the last activity of the user. Banking data is not retained by Wikicampers in any case.

 

Furthermore, the company may, unless otherwise indicated by the client sent by email to [email protected], use the personal data concerning them (excluding banking data) to send them directly or through partners commercial offers that may interest them.

 

Under the Data Protection Act, the client has the right to oppose the receipt by email of unsolicited commercial prospecting documents.

 

The client also has the right to access, modify, rectify, or delete data concerning them (article 34 of the “Data Protection Act”), and may also oppose the transmission of their personal data to third parties by sending an email to the Wikicampers Customer Service.

18. Applicable law and competent jurisdictions 

These General Terms and Conditions of Sale are subject to French law.

 

The parties to the sale are free to bring the competent jurisdictions and/or seek their advice to reach an agreement other than that proposed by Wikicampers.

 

Any request for a complaint, or information under the insurance mediation, can be sent in writing to the following address: Wikicampers Complaint Service, 29 allée Grace Hopper 64210 Bidart. You will receive an acknowledgment of receipt within a maximum of 10 days and a response within 2 months.

 

In accordance with article L. 612-1 of the Consumer Code, the consumer, subject to article L.612.2 of the Consumer Code, has the option to introduce a request for amicable resolution by mediation, within a period of less than one year from their written complaint to the professional.

 

HORS LIMITES 64 has designated, by adhesion registered under number 17332/VM/2511 the SAS Médiation Solution as the entity for consumer mediation.

 

To contact the mediator, the consumer must formulate their request:

  • A brief statement of the facts,
  • A copy of the prior complaint,
  • All documents allowing the processing of the request (order form, invoice, proof of payment, etc.)
